We Quilt, Inc. (“Quilt”, “we”, “our” or “us”) is committed to respecting and protecting your privacy. This privacy policy (“Privacy Policy”) describes and explains how we collect, use, share and protect personal information you share with us. “Personal Information" is information that enables us to identify you, such as your name and e-mail address. We process Personal Information both as a Processor and as a Controller as defined in the GDPR. Our Privacy Policy is part of the Terms of Service for the Quilt Platform, and all terms not defined in this Privacy Policy are defined in the Terms of Service. Please read this policy carefully so that you understand our privacy practices. We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy. If you do not agree to this Privacy Policy, do not use the Quilt Platform or give us any of your information.

Information We Collect

We collect your information, such as name, email and address, when you register for the Quilt Platform or sign up for our newsletter. To participate in certain activities and to obtain certain services offered on the Quilt Platform, you may be asked to provide additional information such as phone number, billing address, profession, photographs, credit card information, and all of the other information that you choose to provide. As you engage with us on the Quilt Platform, by sending us or other Members communications or request our support using the Quilt Platform, we collect the information you provide in these interactions as well. When you visit the Quilt Platform we also collect non-personally identifiable information, which is information that by itself cannot be used to identify or contact you, including demographic information (such as age or gender) or usage information (such as the browser you are using, the URL that referred you to the Quilt Platform and the areas of the Quilt Platform that you visit).

No Use for Children Under the Age of 18

The Quilt Platform is not intended for children under 18 years of age. If you are under 18, do not use or provide any personal information on or through the Quilt Platform or about yourself to us. If you believe we may have information from or about a child under 18, please notify us at hello@wequilt.com.

Information We Use

We use your information in order to improve the Quilt Platform for all of our Members, such as:

  • To support the functioning of the Quilt Platform itself and the services offered, and to inform improvements to both,
  • To contact you for your feedback, or to respond to feedback you have provided,
  • To conduct research about our audience, including the demographics thereof, and how you are using the Site,
  • To process your payments and fulfill your payouts,
  • To notify you of policy changes including changes to our Terms or Privacy Policy,
  • To offer you promotions or to process your entrance in and any fulfillment of promotions you choose to take advantage of.

Sharing & Disclosure

We will not rent or sell your information to third parties outside of Quilt without your consent. We may share information about you as follows:

  • If sharing the information is reasonably necessary to provide or otherwise make available the Quilt Platform and any feature of the Quilt Platform or a service that you have requested;
  • With third-party vendors or consultants who need access to such information in order to provide support for the services we offer via the Quilt Platform;
  • With third-party websites and other third-parties that we engage for our marketing and promotional purposes, all who have signed an agreement with us to handle your information in a manner consistent with this Privacy Policy;
  • In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation;
  • If we believe your actions are inconsistent with the Terms or our other policies and in order to protect the rights, property, and safety of the Quilt Platform and our Members;
  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company; and
  • With your consent or at your direction. We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.

Third-Party Sites

The Quilt Platform may contain links to other sites. Quilt is not responsible for the privacy practices of such other sites. For more information about the purpose and scope of data collection and processing of your information in connection with such third-party sites please read their privacy policies before visiting or providing your information to third-party sites.

Social Media Features and Widgets

Our Site may integrate with social sharing features or other related tools which let you share actions you take on the Quilt Platform with other apps, sites or media, and vice versa. These features may enable the sharing of information with your friends or the public, depending on the settings you choose with the social sharing service. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the companies that provide these features.

Cookies

We use cookies and other similar technologies for a variety of reasons including to remember preferences, track conversions, conduct marketing and promotional efforts, analyze site traffic and trends, and generally understand the online behaviors and interests of our Members. We may use third-party advertising companies to serve ads on our behalf or to provide other advertising services. These companies may use a cookie, to tailor the ads you see on the Quilt Platform and other sites, to track your response to their ads or to award incentives to their members who respond to their ads. Analytics Services Provided by Others

We may allow others to provide analytics services. These entities may use cookies, web beacons, and other technologies to collect information about your use of the Quilt Platform and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information. Quilt and others may use this information to, among other things, analyze and track data, determine the popularity of certain content, and better understand user online activity.

Access Your Information

As a visitor, you have the right to request access to the information we have collected about you. You can do this by contacting us at hello@wequilt.com. We will provide you with an electronic copy of the information we process about you.

Correcting or Deleting Your Information

You may change or delete information we have about you at any time by editing your Quilt Profile or by contacting us at hello@wequilt.com, but please know that we may retain certain information about you as required by law.

If you ask Quilt to delete your record, your record will be deactivated and then deleted from our user database without undue delay and in no case longer than 30 days.

If you have signed up to receive promotional emails from us, you can choose to “opt-out” of receiving direct marketing from us in the future by indicating that you would like to “opt-out” in any such communication or by emailing us directly at hello@wequilt.com. If you opt-out, we may still send you non-promotional communications, such as those about your Quilt Account or changes to our Terms or policies.

Security and Data Storage

We are committed to protecting your information. Quilt takes reasonable precautions to safeguard your information from loss, misuse, disclosure, alteration, unauthorized access, and destruction. However, we cannot ensure the security of any information you transmit to Quilt or guarantee that information may not be accessed, disclosed, altered or destroyed.

International Privacy Laws

If you are using the Services from outside the United States, please be aware that you are sending your Personal Information to the United States where our servers are located. The information may then be transferred within the United States or back out of the United States to other countries, outside of your country of residence. These countries may not have data protection laws as comprehensive as those in your country of residence; however, our collection, storage and use of your Personal Information will at all times continue to be governed by this Privacy Policy.

Your Consent to this Privacy Policy

By using the Quilt Platform, you agree to this Privacy Policy. We may occasionally update this Privacy Policy. The date of the most recent update of this document will always be displayed at the beginning of this page. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the information we collect. Your continued use of the Quilt Platform constitutes your agreement to this Privacy Policy and any updates.

Membership Terms

These Terms of Membership (“Membership Terms”) which apply between you and Quilt in connection with your Quilt Membership are in addition to the Terms of the Quilt Platform. By signing up for a Quilt Membership, the Quilt Member agrees to be bound by the Membership Terms. We reserve the right to change these Membership Terms at any time at our discretion. If we make changes to these Membership Terms, we will provide notice of the changes, by sending you an email, to the address we have on record, notifying you that new Membership Terms are in effect. Your continued use of the Quilt Platform after you have received notice of the new Membership Terms will confirm that you accept the new Membership Terms in full.

Membership Services and Fees

All Membership services provided by Quilt and the associated Membership fee(s) will be presented to you on the Quilt Platform prior to signing up for Membership. We reserve the right to implement new or increase Membership Fees in our sole discretion. In such cases, Members will be given 30 days’ notice and notified in writing of any such change in pricing.

Cancellation and Payment Processing

Quilt Membership is on a month-to-month, quarterly or yearly basis. All Membership Fees are non-refundable. If you would like to cancel your Quilt Membership for the following period you can do so at any time prior to submitting payment for that month by emailing us at Membership@wequilt.com.

Quilt will process all Membership Fees using a third-party payment processing provider, Recurly. By purchasing a Quilt Membership you acknowledge that we are bound by Recurly’s terms and conditions (https://recurly.com/legal/terms) and Recurly’s privacy policy (https://recurly.com/legal/privacy) (“Recurly Policies”) and that to the extent applicable, you agree to be bound by the Recurly Policies as well. You consent and authorize Quilt to share your information with Recurly to the extent necessary to process your payment for your Quilt Membership.

The Quilt Thread

As a Quilt Member you will be granted access to our Quilt Membership Thread (“Quilt Thread”), a private Facebook Group for Members only. You acknowledge that Quilt is not responsible for material posted to the Quilt Thread by Quilt Members. However, Quilt has the right (but not the obligation) in its sole discretion to monitor and administer the Quilt Thread and refuse or remove any content submitted or posted by a Quilt Member, in whole or in part, that, in Quilt’s judgment, does not comply with Quilt’s Terms, these Membership Terms, or is otherwise undesirable, inappropriate or inaccurate. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of such submitted material.

Quilt Members must comply with the terms identified in the Facebook User Agreement found at https://www.facebook.com/#!/terms.php.

Ownership of The Quilt Thread and Its Contents

All terms related to the ownership of the content on The Quilt Thread (including Member Content and Quilt Content) are set forth in full in Section 3 of our Terms.
